§ 150.03 BUILDING CODE ADOPTED.
   (A)   Minnesota State Building Code. The Minnesota State Building Code, as adopted by the Commissioner of Administration pursuant to M.S. Chs. 16B.59 to 16B.75, including all of the amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Administration, through the Building Codes and Standards Division:
      (1)   Is adopted by reference with the exception of the optional chapters, unless specifically adopted in this section; and
      (2)   Is incorporated in this section as if fully set out herein.
   (B)   Application, administration and enforcement. This Code:
      (1)   Shall be applied, administered, and enforced in accordance with the Minnesota State Building Code;
      (2)   Shall be enforced within the extraterritorial limits permitted by M.S. § 16B.62, Subd. 1, as it may be amended from time to time, when so established by this section; and
      (3)   Shall be enforced by the Minnesota certified Building Official designated by the city to administer this Code (M.S. § 16B.65, Subd. 1, as it may be amended from time to time).
   (C)   Permits and fees.
      (1)   The issuance of permits and the collection of fees shall be as authorized in M.S. § 16B.62, Subd. 1, as it may be amended from time to time.
      (2)   Permit fees shall be assessed for work governed by this Code in accordance with the schedule of fees, rates, and charges adopted by ordinance from time to time; and a surcharge fee shall be collected on all permits issued for work governed by this Code in accordance with M.S. § 16B.70, as it may be amended from time to time.
   (D)   Violations and penalties. A violation of the provisions of this Building Code is a misdemeanor (M.S. § 16B.69, as it may be amended from time to time), and this Building Code may be enforced by any one, all, or any combination of the following penalties and remedies:
      (1)   By imposing an administrative penalty, pursuant to § 10.98 of this Code.
      (2)   By charging a criminal offense, pursuant to M.S. § 326B.082, Subd. 16, and § 10.99 of this Code.
      (3)   By injunction, abatement, mandamus, or any other appropriate remedy in any court of competent jurisdiction.
   (E)   Official copy. One copy of the Minnesota State Building Code:
      (1)   Shall be marked “CITY OF JACKSON - OFFICIAL COPY”;
      (2)   Shall be kept in the office of the City Administrator; and
      (3)   Shall be open to inspection and use by the public.
   (F)   Effective date. The effective date of this section is July 2, 2003.
