§ 118.36 PEG ACCESS CHANNEL(S).
   (A)   A franchisee shall provide to each of its subscribers who will receive all, or any part of, the total services offered on the system, reception on at least one specifically designated access channel available for public, educational, and governmental use on a nondiscriminatory basis.
   (B)   Channel time and playback of prerecorded programming on this specially designated access channel shall be provided without charge to the general public, provided, however, that personnel, equipment, and production costs may be assessed for live studio presentations exceeding five minutes in length. Charges for such production costs shall be consistent with the goal of affording the public a low-cost means of television access.   
   (C)   The specially designated access channel(s) may be used without charge by local education authorities and local government on a nondiscriminatory basis during those hours when the channel is not in use by the general public.
   (D)   A franchisee must make readily available for public use at least the minimal equipment necessary for the production of programming and playback of prerecorded programs for the access channel(s). Upon request, a franchisee shall also make readily available the minimum equipment necessary to make it possible to record programs at remote locations with battery-operated portable equipment.
   (E)   The franchisee shall establish rules pertaining to the administration of the specially designated access channel(s).
   (F)   Franchisees providing subscribers only alarm system services or only data transmission services for computer operated functions shall be exempt from this requirement.
