An applicant convicted of a disqualifying obscenity crime as defined by M.S. §§ 617.23 through 617.299, inclusive, as it may be amended from time to time, may qualify for an license only when the following time period has elapsed:
(A) Two years from the date of conviction or from the date of release from confinement imposed for the conviction, if the conviction is of a misdemeanor offense; or
(B) Five years from the date of conviction or from the date of release from confinement imposed for the conviction, if the conviction is:
(1) Of a gross misdemeanor or felony offense; or
(2) Of 2 or more misdemeanor offenses occurring within any 24-month period.
