To receive a license to operate an adult oriented business, an applicant and the licensed premises must meet the following standards:
(A) The applicant must be 18 years of age or older;
(B) The applicant or applicant’s spouse must not have been denied a similar license, or had a similar license revoked, by any other city, county, or state within the preceding 12 months;
(C) All real estate taxes payable on the licensed premises in the year for which the license is to be issued must be paid in full;
(D) The licensed premises must meet all of the provisions of this chapter and all building and fire codes;
(E) The applicant or spouse must not have been convicted of any felony or gross misdemeanor involving moral turpitude, prostitution, or obscenity or of any other crime of a sexual nature or involving the use or distribution of a controlled substance as defined by Minnesota laws or the use or distribution of a dangerous weapon. Pending appeal from a conviction shall not affect the disqualification of the applicant;
(F) All license and investigation fees required by this chapter must be paid in full;
(G) For purposes of this section, APPLICANT shall include an individual, each person having a financial interest in a partnership, limited liability company, or joint venture, and in the case of a corporation, all officers, directors, and stockholders required to be named on the application.
