§ 115.24 APPLICATION.
   Each person intending to operate an adult oriented business in the city shall first apply for a license therefor on forms provided by the city and submitted to the City Administrator at City Hall.
   (A)   Full disclosure. The applicant must fully answer all questions asked and must provide all information requested by the application form.
   (B)   False statements. It is unlawful for any applicant to intentionally make a false statement on or an omission from any application form.
      (1)   Any such false statement or omission, when discovered, shall work an automatic refusal of license or, if already issued, shall render void and of no effect any license issued pursuant to the application.
      (2)   Any such refusal or voiding of the license shall not protect the applicant from prosecution for any violation of this chapter or any part thereof.
   (C)   Contents.
      (1)   The application must contain the address and legal description of the property to be used for the business and the following information for the applicant, for each owner, lessee, practitioner, manager, and employee of the business, and for 2 other persons who are then residents of the state and who, if called upon, can attest to the character of each owner, lessee, practitioner, manager, and employee of the business: name, address, phone number, date of birth; whether the person has ever been convicted of a crime or offense other than a trade offense and, if so convicted, complete and accurate information regarding the facts of offense upon which the conviction was based and the disposition of the case; and the name and address of each creditor of the person for credit extended for the purposes of constructing, equipping, maintaining, operating, furnishing, or acquiring the premises, personal effects, equipment, or anything incident to the establishment, maintenance, and operation of the business.
      (2)   If the application is made on behalf of a corporation, joint business venture, partnership, limited liability company, or any other business entity, the applicant shall submit with the application accurate and complete records showing the date and state of incorporation or other form of formal organization and for each partner, officer, owner, shareholder owning more than 5% of the stock in the corporation, director, and creditor of the entity, all of the information required regarding a person mentioned in the next preceding subsection.
      (3)   The applicant shall submit with the application complete and accurate documentation establishing the interest of the applicant and each other person having an interest in the premises upon and from which the business is proposed to be located or conducted, in the furnishings thereof, in the personal property thereof, or in the operation or maintenance thereof. Documentation shall be in the form of a lease, deed, contract for deed, mortgage deed, mortgage credit arrangement, loan agreement, security agreement, and any other documentation establishing the interest.
   (D)   Diagram. The application must be accompanied by a sketch or diagram showing the external and internal configuration of the premises, including a statement of total floor space occupied by the business. The sketch or diagram need not be professionally prepared but must be either drawn to a designated scale or drawn to scale with marked dimensions of the interior of the premises to an accuracy of plus or minus 6 inches.
