§ 74.04 DRIVER LICENSE AND PERMIT REQUIRED.
   No person shall drive or operate an ATV or a golf cart on any street, roadway, or shoulder thereof in the City unless the driver has in possession a valid, current and unrevoked [i] driver license issued by the State of Minnesota or another state, and [ii] permit issued by the City for such driving or operating of an ATV.
   (A)   Application for permit. Application for an individual permit shall include the full name and address of the applicant; the applicant’s date of birth; the state of issuance of the applicant’s current driver license; the number of the driver license; the name and address of the insurer providing vehicle liability insurance coverage; the name and address of the local insurance agent for the insurer; the number of applicant’s insurance policy; the date of expiration of insurance coverage; the date of application; and the applicant’s signature.
   (B)   Physician’s certificate. As a condition to obtaining an individual permit, the City may require an applicant to submit a writing signed by a physician certifying that the applicant is able to safely operate an ATV or a golf cart on the streets, roadways, and shoulders thereof in the City.
   (C)   Issuance. Upon an applicant’s compliance with this chapter, the City Administrator or authorized designee shall issue a permit to drive and operate ATVs, golf carts, or both in accordance with this chapter.
   (D)   Revocation.
      (1)   The City Administrator may revoke an individual permit if:
         (a)   There is any material misrepresentation made in the permit application;
         (b)   Liability insurance covering the ATV or golf cart operated by the permit holder is not in effect;
         (c)   There is evidence that the permit holder cannot safely operate the ATV or golf cart; or
         (c)   The permit holder no longer has a valid driver license.
      (2)   The City Administrator shall issue a written notice of revocation of the permit (the “notice”) and shall either hand deliver the notice to the permit holder or send the notice by certified mail addressed to the permit holder at the address on the application.
      (3)   The revocation shall be in effect immediately on personal service of the notice or three days after the mailing of the notice.
   (E)   Expiration. Permits shall be issued for a period of five years.
