§ 71.04 SKATEBOARDING AND ROLLER SKATING.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CENTRAL BUSINESS DISTRICT. The area of the city bounded on the north by the south curb line of Sheridan Street, on the east by the east curb line of First Street, on the south by the south curb line of White Street, and on the west by the west curb line of Fourth Street.
      ROLLER SKATES. A shoe with wheels attached or a device with wheels which is designed to be attached to a shoe.
      SKATEBOARD. A wheeled, self-propelled device designed to transport a rider in a standing position, which device is not otherwise secured to a rider’s feet or shoes.
   (B)   Restrictions on use.
      (1)   It is unlawful for any person to ride a skateboard or to use roller skates:
         (a)   On any public sidewalk, on any public street, or on any public parking lot within the Central Business District between the hours of 8:00 a.m. and 6:00 p.m. on any day of the week except Sunday and Thursday; between the hours of 12:00 noon and 6:00 p.m. on Sunday; and between the hours of 8:00 a.m. and 9:00 p.m. on Thursday.          (b)   In any careless, reckless or negligent manner so as to endanger or be likely to endanger the safety of any person or property of any other person. (Ord. 3, 5th Series, eff. 6-7-1990)
         (c)   On any public street or sidewalk or in any public park after sunset and before sunrise unless the person is equipped:
            1.   With a lamp emitting a white light visible from a distance of at least 500 feet to the front and with a red reflector of a type approved by the Department of Public Safety which is visible from all distances from 100 to 600 feet to the rear when directly in front of lawful lower beams of head lamps on a motor vehicle; and
            2.   With a minimum of 20 square inches of reflective material on each side (side reflectors as required by regulations for new bicycles prescribed by the United States Consumer Product Safety Commission shall be considered to meet the requirements for side reflectorization contained in this subsection).          (d)   On any state highway within the city. (Ord. 3, 5th Series, eff. 6-7-1990)
         (e)   On the following described tracts owned by the county: Lots 6 and 8 in Block 17 (Human Services Building); all of Blocks 24, 32, and 33 (Resource Center); all of Block 25 (Courthouse); and the south half of Block 26 (County Law Enforcement Center), all in the Original Town (now City) of Jackson, according to the plat thereof.
      (2)   No person riding a skateboard or roller skates shall attach the same or their person to any vehicle upon a roadway.
      (3)   Every person riding a skateboard or roller skating on any public street shall ride as close as possible to the right-hand curb or edge of the roadway.
   (C)   Impoundment. A person apprehended by a police officer violating this section does by his or her use of the public streets and sidewalks consent to the impoundment of his skateboard or roller skates used to commit the violation for a period of 3 days upon the first offense, 7 days upon the second offense, and 30 days upon any subsequent offense. Any person aggrieved by the impoundment of his or her skateboard or roller skates may petition the Council for a hearing at any regular Council meeting following the impoundment.
