§ 52.05 CONTRACT FOR REFUSE COLLECTION.
   (A)   Council to let contract. Subject to the provisions of this section the Council shall grant, by contract let to the lowest responsible bidder, the authority to collect and dispose of all refuse originating within the city. The City Administrator shall prepare specifications for advertising for bids for the contract, and he shall see that when let, the contract is executed in accordance with its terms and this section.
   (B)   Terms. Initially the contract shall be for such term as the Council deems appropriate.
   (C)   Liability insurance.
      (1)   It shall be a condition of the contract that the applicant file with the Clerk a current policy of public liability insurance covering all vehicles to be used by the applicant in the contractor’s business. The limits of coverage of the insurance are:
         (a)   Each person injured, at least $100,000;
         (b)   Each accident, at least $200,000;
         (c)   Property damage, at least $25,000.
      (2)   Each policy shall expressly provide that the city be given 10 days notice of any termination or cancellation of the coverage. Each contract shall terminate upon termination of the required insurance coverage.
   (D)   Vehicles. Each refuse collection vehicle shall be marked on the outside so as to identify the contractor. Every vehicle used for hauling garbage shall be covered, leak-proof, durable, and of easily cleanable construction. Every vehicle used for hauling refuse shall be sufficiently air-tight and so used as to prevent unreasonable quantities of dust, paper, or other collected materials to escape. Every vehicle shall be kept clean to prevent nuisances, pollution or insect breeding and shall be maintained in good repair.
   (E)   Contract collector. It is a petty misdemeanor for any person to collect refuse except the person holding a contract with the city to do so or to permit refuse to be picked up from his or her premises except by the contractor.
