1327.02 ENCLOSURE REGULATIONS.
   No person shall locate, construct, install, make, change or use a private swimming pool, club swimming pool, public swimming pool or commercial swimming pool unless such pool or the premises upon which it is located is enclosed by a fence or other boundaries not less than forty-eight inches in height, measured from ground level, so constructed, and of such strength that children under the ages of seven are unable to pass through, and the gates of such fence shall be constructed so they may be locked when the pool is not in use. Gates and entrances shall be locked or latched whenever the pool is not in use. Gates and entrances shall be locked or latched whenever the pool is not supervised by a person at least fourteen years of age. Above ground pools will be considered in compliance if all sides are a minimum of four (4) feet in height, measured from the ground and the ladder or other access points are raised or locked when not in use.
