§ 111.09 SOLICITING ON HIGHWAYS AND STREETS RESTRICTED.
   (A)   (1)   No solicitor shall stand upon any highway or public street for the purpose of soliciting contributions from the occupant of any vehicle in violation of ILCS Ch. 625, Act 5, § 11-1006. Solicitation on public highways or streets in the village shall be permitted only at the following intersections:
         (a)   The intersection of Irving Park Road and Prospect Avenue;
         (b)   The intersection of Irving Park Road and Walnut Street;
         (c)   The intersection of Irving Park Road and Rohlwing Road.
      (2)   Any such solicitation shall only be authorized between the hours of 7:00 a.m. and 3:00 p.m. daily, and only upon the following conditions:
   (B)   Any solicitor engaged in solicitation upon a public street shall be at least 18 years of age and shall wear a high-visibility vest. Solicitors shall stand on or so near to the curbside of the street as to avoid creating a traffic hazard. In no event shall solicitors obstruct or impede the flow of traffic on any street.
   (C)   Any such soliciting person or agency shall be registered with the Illinois Attorney General as a charitable organization as provided by the Solicitation for Charity Act, as amended, being ILCS Ch. 225, Act 460.
   (D)   The soliciting person or agency shall be liable for any injuries to any person or property during such solicitation which is causally related to any act of ordinary negligence of the soliciting agent.
   (E)   Prior to soliciting on any highway or public street in the village as provided in this section, the soliciting agency shall obtain a highway solicitation permit and shall file with the Village Clerk at the time of application for such permit, the date or dates on which said highway solicitation will occur within the village. Prior to issuance of the highway solicitation permit, the soliciting agency shall file with the following with the Village Clerk:
      (1)   A release and indemnification agreement, in a form acceptable to the village, whereby the soliciting agency and its successors agrees to release the village from any liability, and to indemnify, defend and hold the village, its President and Board of Trustees, and its officials, officers, employees, agents and volunteers, harmless from and against any and all liability arising out of claims for bodily injury, including personal injury and accidental death and property damage or any such claim for damage arising out of the acts or omissions of the soliciting agency and any of the individuals soliciting on its behalf in connection with solicitation upon any public streets or highways; and
      (2)   A certificate of insurance demonstrating that the soliciting agency, person or entity has commercial general liability and property damage insurance in full force and effect covering the days on which the soliciting agency intends to solicit on the said highways or public streets in the village to protect it from claims for bodily injury, including personal injury and accidental death, as well as claims for property damage, in an amount not less than $1,000,000 for bodily injury on account of any one occurrence, and property damage of not less than $300,000 on account of any one occurrence, with combined aggregate limits of not less than $1,000,000. Said certificate of insurance shall name the village as additional insured thereon and shall provide that the insurance policy is non-cancelable unless the village is given 30 days prior written notification.
