§ 97.11 FALSE ALARMS FINES; NOTIFICATIONS.
   (A)   Any licensed alarm user who has more than three false alarms within a calendar year at a single protected location, will be assessed fines according to the following fine schedule:
 
1-3 false alarms
no charge
4-5 false alarms
$75.00 per false alarm
6-7 false alarms
$150.00 per false alarm
8-9 false alarms
$350.00 per false alarm
10 or more false alarms
$500.00 and initiation of permit revocation process
 
   (B)   No false alarm shall be deemed chargeable within the first seven days of initial activation so as to provide the alarm company and alarm user a reasonable time period to properly install, train, and modify the system.
   (C)   Any alarm user permit holder who fails to pay fines or charges provided for under this chapter within 30 days from the date of the invoice requesting payment of same, shall have the subject Alarm User Permit revoked. In addition to revocation, any unpaid fines outstanding for 60 days or more shall be forwarded to a collection authority designated by the Chief of Police. Any such alarm user permit shall not be reinstated until all unpaid fines and fees are paid in full.
   (D)   The Alarm System Coordinator shall notify the alarm user in writing, of each instance wherein the Police Department recorded a false alarm. The alarm user shall have the opportunity within 14 days from the date of mailing or personal delivery, to submit a report or to meet with the Alarm System Coordinator for the purpose of showing cause as to whether circumstances exist to warrant voiding the penalty of the false alarm. The Alarm System Coordinator shall review the alarm user's report and/or meet with the alarm user and issue a written finding to the alarm user as to whether or not the false alarm will be voided. The finding of the Alarm System Coordinator shall be final.
   (E)   After three false alarm dispatches, the alarm user must have a properly licensed alarm business modify the alarm system to be less susceptible to false activation, or provide additional user training as appropriate.
