§ 72.45 RELEASE OF IMPOUNDED VEHICLES.
   (A) If an owner of a vehicle impounded for reasons other than listed in § 72.42 wishes to recover a vehicle, the owner shall:
      (1)   Be required to show proof of ownership and identity;
      (2)   Complete the Waiver/Request for Hearing Form and elect one of the following options:
         (a)   Waive the tow hearing, at which time the owner of the vehicle will be directed to the company that towed the vehicle and pay the tow bill.
         (b)   Request a hearing, at which time the owner of the vehicle will complete and file with the Department a request for a hearing. This may be filed in person, by mail or by fax. The hearing will be held within seven business days, following submission of the request. The hearing may be held at a later date if the owner and Department agree to a date and time that is amenable to both parties.
         (c)    Request a delayed hearing, in which case the hearing will be scheduled within seven business days after filing, unless the owner requests a later date.
   (B)   If the vehicle was held for possible seizure at a village impound lot and is ultimately released, it shall be ensured that the individual claiming the vehicle has paid the appropriate towing fees to the towing company that removed the vehicle at the request of the Itasca Police Department. If this type of vehicle is to be released, the following procedures will apply prior to the vehicle being released to the registered owner:
      (1)   The owner or person legally entitled to control the vehicle will be notified that the vehicle has been authorized for release and has one day to arrive at the Itasca Police Department and claim the vehicle.
      (2)   The notification of release may be made by telephone or registered mail, but must be documented in a supplemental to the original case report.
      (3)   If the registered owner or other individual entitled to the vehicle does not arrive at the Itasca Police Department on or before first full day after notification was provided, that individual may be charged a storage fee for leaving the vehicle in the village impound lot.
         (a)   Storage fees shall be applied at the rate of $15 per day.
         (b)   The fee shall be for the purpose of offsetting, to the extent practicable, the cost to the Village of Itasca in implementing, enforcing, and administering the provisions of this general order.
         (c)   Storage fees may be waived or reduced at the direction of the Chief of Police.
         (d)   Storage fees are to be made payable to the Village of Itasca and forwarded for deposit into the appropriate Village account.
