1042.33 MUNICIPAL CIVIL INFRACTION.
   (a)   Any violation of any provision of this chapter, or any orders or wastewater discharge permits issued hereunder, or any pretreatment requirements, or the introduction or discharge of any substance into the sewage collection and disposal system which causes personal injury or property damage, or the making of any false statements, representations or certifications in any application, record, report, plan, wastewater discharge permit, order, or other documentation filed or required to be maintained under this chapter, or the tampering with or rendering inaccurate any monitoring device or method required under this chapter, shall be deemed a municipal civil infraction pursuant to Section 202.99 of these Codified Ordinances.
   (b)   Unless otherwise specifically provided for herein, the fine for each violation of this chapter shall be not more than one hundred dollars ($100.00) per day, plus costs. Each act of violation, and each day on which any violation continues, shall constitute a separate offense.
   (c)   Increased fines may be imposed for repeat violations as follows:
      (1)   For any first repeat offense, the fine shall be not more than five hundred dollars ($500.00) per day, plus costs;
      (2)   For any second repeat offense or any subsequent repeat offense, the fine shall be not more than one thousand dollars ($1,000.00) per day, plus costs.
   (d)   These provisions shall not replace or relieve the violating user from injunctive relief, civil penalties, or criminal prosecution where deemed appropriate by the City.
   (e)   Authorized City Official. The City Manager, and any representative designated in writing by the City Manager, is hereby designated as the authorized City official to issue municipal civil infraction citations for any violation of this chapter.
