In the case of any call to respond to a hazardous materials call, the party causing such release shall sign a "Notice of Liability" form that shall require all associated response costs to be paid. In no case shall a waiver be granted for hazardous material response. Included in costs are the costs of the Department of Public Safety, Emergency Management (City and/or County), mutual aid departments, and any professional agency required to contain and clear the incident. Failure to pay the liability may result in prosecution both criminally and civilly for the response.
