1222.99 PENALTY; EQUITABLE REMEDIES.
   (d)   A violation of these Subdivision Regulations is a Municipal civil infraction, for which the fine shall be not less than two hundred fifty dollars ($250.00) nor more than one thousand dollars ($1,000) for the first offense and not less than five hundred dollars ($500.00) nor more than two thousand, five hundred dollars ($2,500) for any subsequent offense, in the discretion of the Court, in addition to all other costs, damages and expenses provided by law. For purposes of this section, “subsequent offense” means a violation of these Regulations committed with respect to a separate incident by the same person within twelve months of a previous violation of these Regulations for which said person admitted responsibility or was adjudicated to be responsible. Each day such violation continues shall be considered a separate offense. The landowner, tenant, subdivider, builder, public official or any other person who commits, participates in, assists in or maintains such violation may each be found responsible for a Municipal civil infraction and be liable for the penalties herein provided. Nothing herein contained shall prevent the City Council or any other public official or private citizen from taking such lawful action as is necessary to restrain or prevent any violation of these Regulations or of the Subdivision Control Act.
   (e)   In addition to any other available remedy, the City Council may, in its discretion, bring an action in its own name to restrain or prevent any violation of these Regulations or any continuance of such violation. In such case, the person found violating these Regulations shall pay the City’s costs and expenses in enforcing these Regulations, including its attorney’s fees.
