(a) Construction; Duty of Owner. It shall be the duty of the owner of any real property within the City to construct a sidewalk abutting or adjacent to such property whenever the City Council, by resolution, shall determine that the construction of such sidewalk is necessary for the public health, safety or welfare.
(b) Maintenance and Repair; Duty of Owner. It shall be the duty of the owner of any real property within the City to maintain and keep in good repair any sidewalk abutting or adjacent to such property.
(c) Resolution to Construct or Repair. Whenever the City Council shall determine that it is necessary for the public health, safety or welfare that a sidewalk be constructed or repaired, it shall adopt a resolution requiring the construction or repair thereof and shall, in such resolution, direct the owner of the real property abutting or adjacent to the proposed location of the sidewalk to be constructed, or the existing sidewalk to be repaired to complete said work within thirty days from the date of such resolution. A copy of such resolution shall be served upon the owner either personally or by first class mail, addressed to such owner under the name and at the address as shown upon the City's latest assessment roll. The resolution shall provide that the City shall perform the work if the property owner does not, and that the cost shall be assessed against the property.
(d) Failure or Refusal to Construct or Repair. If the owner of the property shall fail or refuse to construct or repair a sidewalk abutting or adjacent to the property within the period of time specified in the resolution referred to in subsection (c) hereof, the City shall proceed to have the sidewalk constructed or repaired. The cost of such construction or repair shall be charged against and shall be a lien upon the property which the sidewalk abuts or adjoins. The lien shall be the type applicable to special assessments.
(e) Participation of City in Cost. The City may participate in the cost of construction or repair of any sidewalk under the provisions of this chapter. If the City determines to participate in the cost, it shall so provide in the resolution of the City Council described in subsection (c) hereof, which shall state the share that the City will pay for the construction or repair of the sidewalk.
