Each licensee, upon receipt of the license required by Section 850.02, shall, in the presence of the City Clerk, affix his or her signature thereon, accepting the license and all the conditions of its use as stated in this chapter or other ordinances of the City, respecting the use of such license, and agreeing to the suspension and revocation of such license if any such condition is violated.
The following conditions and regulations shall apply to the exercise of privileges granted by licenses issued under this chapter, in addition to those set forth in other parts of this chapter or in these Codified Ordinances:
(a) No licensee shall use any weighing or measuring device in the conduct of his or her business, or have in his or her possession any weighing or measuring device, unless such device has been examined and approved by the State Sealer of Weights and Measures.
(b) No licensee shall sell or offer for sale any article or commodity purported to be in quantities of standard weight or measure, whether or not in the original package, unless the same is actually of the weight or measure purported.
(c) No licensee shall sell or offer for sale any unsound, unripe or unwholesome food, or a defective, faulty, incomplete or deteriorated article of merchandise, unless the goods are so represented to the prospective customers.
(d) Every owner licensed to sell or vend from a vehicle shall be entitled to one helper for such vehicle.
(e) The Clerk may require that the goods, wares and merchandise of an applicant for the license required by Section 850.02 be inspected by the City Manager or his or her designee before issuing a license under this chapter. The Clerk shall refuse to issue a license to any applicant, and may revoke any license issued under this chapter, if such goods, wares or merchandise are found to be a fire hazard by the inspecting official.
(f) Persons peddling or vending goods from a vehicle under this chapter shall comply with the provisions of the City Traffic Code relative to vehicles, and shall not allow any such vehicle to remain standing for peddling or vending purposes at one place on any street, alley or public place for more than ten minutes on any one block.
(g) The license required by Section 850.02 shall be worn in full view on the person to whom it was issued.
(h) No person shall solicit, canvass or peddle in any manner on Monday through Saturday before 9:00 a.m. or after 8:00 p.m., or on Sundays before 1:00 p.m. or after 8:00 p.m.
