(a) Public Purpose. It is hereby deemed to be in the best interest of the health, safety and welfare of the citizens of the City of Ionia, Michigan, that the City Council, by ordinance, prohibit public nudity, as defined below, within the boundaries of the City of Ionia. This section is adopted by authority granted to the City of Ionia as a Home Rule City by Act 279 of the Public Acts of 1909, as amended.
(b) Definition of "Public Nudity". For purposes of this section, "public nudity" shall be defined as "knowingly or intentionally displaying in a public place, or for payment or promise of payment by any person, including, but not limited to, payment or promise of payment of an admission fee, any individual's genitals or anus with less than a fully opaque and nontransparent covering of the nipple and areola. A woman's breast feeding of a baby does not under any circumstances constitute nudity irrespective of whether or not the nipple is covered during or incidental to the feeding.
(c) Public Nudity Prohibited. No person shall commit the act of public nudity as defined in subsection (b) hereof.
