9-3-4: AUTHORITY TO MOVE BUILDING:
   A.    Permission to move the building or structure shall be given by the building official when the report of the department states that the building or structure is in compliance with all applicable codes, including, but not limited to, building, electrical, plumbing, etc.; that the building or structure is in a state of good condition and repair; and that the use of the building or structure conforms to the zoning requirements of the zone to where movement is proposed.
   B.    If, in the opinion of the building official, the building or structure can be remodeled, altered and/or reconditioned so as to comply with all the requirements of the building code and applicable ordinances, a permit may be issued conditioned upon completion of the requirements set forth in the report thereof which shall be prepared by the building official. Such a conditional permit may be issued only if: 1) the applicant shall, in writing, agree to comply with the requirements set forth in the report; and 2) the applicant posts a letter of credit in the minimum sum of twenty thousand dollars ($20,000.00) in favor of the city guaranteeing compliance with said conditions. Such letter of credit shall remain in full force and effect until the requirements set forth in the report have been fully complied with. The building official shall release the letter of credit after the requirements have been fully complied with. (1974 Code § 410.07; amd. 2008 Code)
