8-5-5-2: UPGRADE, REPAIR, REPLACEMENT, AND ABANDONMENT:
   A.    Failure To Protect Groundwater: An SSTS that is determined to not be protective of groundwater in accordance with Minnesota rules 7080.1500, subpart 4(B) or 7081.0080, subparts 3 or 4 shall be upgraded, repaired, replaced or abandoned by the owner in accordance with the provisions of this chapter within ten (10) months of receipt of notice of noncompliance from the department.    B.    Imminent Threat To Public Health Or Safety: An SSTS that is determined to be an imminent threat to public health or safety shall be upgraded, repaired, replaced or abandoned by the owner in accordance with the provisions of this chapter within thirty (30) days of receipt of notice of noncompliance from the department.    C.    Abandonment: Any SSTS, or any component thereof, which is no longer intended to be used, must be abandoned in accordance with section 8-5-8 of this chapter and Minnesota rules 7080.2500. (Minnesota rules 7082.0100, subpart 3(B)) (Ord. 1219, 10-25-2010)
