6-2-2: SIGNS:
   A.    Installation Requirements: After a fire lane has been established, the owner of the property adjacent to such fire lane shall, at his own expense, erect signs designating the fire lane. If there is a curb adjacent to the fire lane, the owner of the property adjacent to such fire lane shall, at his own expense, cause said curbing to be painted yellow. The erection of said signs and the painting of the curbing shall take place within sixty (60) days after notification of the establishment of the fire lane has been forwarded to the owner of the property adjacent to such fire lane or within such extended period of time as may be deemed proper by the chief of the fire department or the fire marshal. (1974 Code § 906.03)
   B.    Sign Specifications:
      1.    Contents: The signs to be erected by the owner of the property involved shall bear the following words:
   NO PARKING
   FIRE LANE
BY ORDER OF THE FIRE CHIEF
      2.    Design: Said signs shall be twelve inches by eighteen inches (12" x 18") and shall have a white background with red lettering thereon and shall be clearly legible from a distance of one hundred feet (100'). Said signs shall be erected on posts adjacent to fire lanes and shall be at least five feet (5') in height. Said signs shall be posted at each end of the fire lane and at least at every one hundred foot (100') interval within the fire lane. The fire chief or fire marshal shall designate the type of paint to be used in painting the curbing adjacent to the fire lane.
      3.    Exceptions:
         a.    The requirement for painted curbs may be dropped for condominium and townhome residential properties when both of the following are met:
            (1)    Sign spacing is sixty feet (60') or less.
            (2)    Adequate enforceability is provided for by the use of signs alone.
         b.    The granting of this exception may be denied or rescinded when, in the opinion of the chief of the fire department, the fire marshal, or the chief of police, adequate enforceability is not provided by the use of signs alone. Whenever this exception is allowed, it shall be entered into the record of the fire department, and a signed copy shall be furnished to the applicant.
      4.    Modifications: The chief of the fire department or the fire marshal may modify the requirements of this subsection when there exists a demonstrated practical difficulty in placing or obtaining such signs, when adequate enforceability can be provided with a sign spacing greater than one hundred feet (100'), and when sign spacing less than one hundred feet (100') is required for adequate enforceability, provided that the intent and purpose of this chapter is observed and the public safety secured. (1974 Code § 906.05)
