A. Any person who violates any provision of this chapter or fails to comply with a lawful written abatement notice issued pursuant to subsection 5-9-6A of this chapter shall be guilty of a misdemeanor, provided, however that a violation of subsection 5-9-4H of this chapter shall be a petty misdemeanor.
B. For violations of this chapter that are declared to be public nuisances on property, the condition may be abated by the city following the procedures pursuant to subsection 5-9-6A of this chapter, and in addition, the owners and responsible parties in apparent control of the property may be issued a misdemeanor citation, provided, however that a violation of subsection 5-9-4H of this chapter shall be a petty misdemeanor.
C. Each violation and every day a violation of this chapter shall occur or continue shall constitute a separate and distinct offense and violation. (Ord. 1291, 4-13-2015)
