A. A permit may be denied upon a finding by the appropriate department that the proposed assembly is incompatible with existing land uses or will be detrimental to the public health, safety, and welfare. Factors considered when determining denial include, but are not limited to the following:
1. Zoning Ordinance conflicts with adjacent properties,
2. Concerns regarding noise, lighting, traffic, water supply, waste disposal, sanitation, fire hazards, congestion of persons, and the ability to contain the assembly on the site,
3. The potential for damage to adjoining properties,
4. Lack of adequate parking areas,
5. The applicant fails to agree to abide by or comply with the conditions of the permit,
6. The information contained in the application is false, or there is a material defect or omission in the application,
7. The diversion of too many law enforcement officers to properly police the event,
8. Another permit has already been approved to hold a different assembly at the same time and place or is so close in time as to cause undue traffic congestion or other complications,
9. Other factors affecting the public health, safety and welfare of the public.
B. In the event the department denies the permit, the applicant may appeal the decision to the City Council. (Ord. 1365, 2-25-2019)
