A. Misdemeanor Violation; Penalties: Any person who violates a provision of this code is guilty of a misdemeanor and, upon conviction thereof, may be punished by a fine of not more than one thousand dollars ($1,000.00) and imprisonment for a term not to exceed ninety (90) days, or both. Each act of violation and every day on which a violation occurs or continues is a separate violation. (1974 Code § 115.01; amd. 2008 Code)
B. Definition Of Misdemeanor And Petty Misdemeanor: A "misdemeanor" is an offense or crime that the city council is empowered to punish with fine or imprisonment; a "petty misdemeanor" is as defined by law. (1974 Code § 115.09)
C. Limitation; Compliance With Statute: The provisions of subsection A of this section notwithstanding, no penalty shall be greater than that established by state statute for the same offense. (2008 Code)
