§ 52.09 APPLICATION OF PAYMENTS WHEN PAYMENT IS LESS THAN TOTAL BILLING.
   (A)   When a utility payment is received by the town from a customer and that payment is less than the amount billed, the customer's payments shall be applied as follows:
   (B)   Any amount in arrears will be paid first and then any remaining payment will be applied to current charges. Payments for charges in arrears will be first to trash/recycling service until that balance is paid in full, any remaining balance of the payment will next be paid to water service until that balance is paid in full, and any remaining balance will then be applied to stormwater service. After the charges in arrears are paid, any remaining balance of payment will be applied to current charges in the same manner and sequence as described for payment of charges in arrears.
   (C)   This application of payments shall continue in all cases, including those instances where the customer has entered into a payment plan and/or promissory agreement with the town. In the case of a payment plan or promissory agreement, each payment is first applied to any existing arrearage, then to the fee for trash/recycling service followed by the fee for water service and finally for the payment towards the outstanding stormwater fee. Funds remaining after the most recent month's billing is paid shall be applied to the charges in arrears as described in the previous division or per the specific terms of the payment plan or promissory agreement.
