§ 50.15 FALL CREEK REGIONAL WASTE DISTRICT; DISCONNECTION.
   (A)   As stated in I.C. 8-1.5-3-4(d), the town will shut off water service to a property/building upon notice from the District that the property is at least 30 days delinquent in sewer fees and due for disconnection, and will turn service back on at the district’s request when the sewer account is paid in full.
   (B)   Fall Creek will pay the town $75 for each property that Ingalls shuts the water off at Fall Creek’s request. Fall Creek will provide notice to the property owner before disconnection as stated in I.C. 8-1.5-3-4(e).
   (C)   Either Fall Creek or the town can ask to review and reconsider the agreement in January of any year.
   (D)   The town and Fall Creek Regional Waste District (FCRWD) have entered into an agreement by which the Town Water Department agrees to disconnect water service for nonpayment of sewage, the following policies and procedures shall be followed:
      (1)   FCRWD agrees to do the following:
         (a)   Sewer bill must be more than 30 days in arrears before water can be disconnected;
         (b)   Provide the Town Water Clerk a list including the name and address for each service to be disconnected;
         (c)   Provide said list to the Town Water Clerk before 12:00 noon on or around the 15th day of each month. (Date can be changed upon agreement by both parties);
         (d)   Provide a tag that will be delivered to each service to be disconnected. The tag must contain the reason the water was disconnected, instructions for having their service restored and a phone number to discuss their account. Tag color cannot be blue or white;
         (e)   Provide the Town Water Clerk a list of services to be re-connected once payment is made to FCRWD; and
         (f)   Agrees to pay the Town Water Department $75 for each address on the list.
      (2)   The Town Water Department agrees to the following:
         (a)   Once the list is received from FCRWD, water service will be disconnected within the same business day;
         (b)   Hang a tag provided by FCRWD at each service to be disconnected;
         (c)   Lock off the service or remove meter in order to prevent theft;
         (d)   Restore service within 24 hours after notification by FCRWD provided service was not also disconnected due to non-payment for water; and
         (e)   Send an invoice to FCRWD for each address on the list.
   (3)   Special circumstances:
         (a)   All disconnects are at the sole discretion of the Town Water Superintendent
         (b)   Customers on a “disconnect ban” such as those on dialysis or other special needs, will not be disconnected.
         (c)   If a meter is inaccessible or the weather is too severe to safely disconnect service, FCRWD will be notified immediately so they can make other arrangements.
         (d)   If service is scheduled to be disconnected due to non-payment for sewer and has already been disconnected due to non-payment for water, service will not be restored until both water and sewer bills are paid. All disconnect/reconnect fees apply to both entities and Town Water Department is entitled to be compensated $75 from FCRWD.
         (e)   At no time will any town water personnel be asked or authorized to accept any type of payment or make any arrangements to avoid disconnection of service.
         (f)   Tap fees, capacity fees or other non-service related fees will not be eligible for this program. No service will be disconnected on a weekend or legal holiday except for emergencies.
         (g)   There will be an additional $50 fee for all service requests after normal business hours.
