§ 50.13 CAPACITY FEE.
   (A)   In addition to any other fees or charges paid to the municipal waterworks to establish a waterworks connection, any new user requesting a new connection to the town’s municipal waterworks shall pay a capacity charge of $1,300 per residential equivalent dwelling unit (“EDU”) except that any existing structure within the corporate boundaries of the town as of the date of the adoption of this section shall pay a capacity fee of $650 per residential equivalent dwelling unit. The water capacity charge constitutes a new user’s payment towards the cost of the facilities of the town’s municipal waterworks by taking into account the cost of such facilities of the town’s municipal waterworks and the allocation of such costs based upon EDUs. The number of EDUs attributable to each category of user is established in division (C) below.
   (B)   If an existing user of the municipal waterworks changes its use resulting in a different amount of EDUs attributable to such existing user, the existing user shall pay a capacity charge equal to the difference between a capacity charge based on the existing user’s classification of EDU usage and. a capacity charge based upon the new classification of EDU usage.
   (C)   One EDU is equivalent to the estimated average daily water usage for a standard single family residence served by a five-eighths to three-quarter inch meter connection to the town’s municipal waterworks. For purposes of determining the estimated EDUs for all users, the following table shall apply:

   (D)   All capacity charges collected by the town under this section shall be used for items of future capital improvement projects or debt retirement.
