§ 10.99 GENERAL PENALTY.
   (A)   It is unlawful for any person to violate any provision of or fail to comply with any of the requirements of this code of ordinances or any provision of any ordinance (including those adopted by reference) of the city not included in this code. Any person violating any provisions of this code or failing to comply with any of the mandatory requirements of this code or any other city ordinance shall be guilty of a misdemeanor, unless the violation is specifically designated as constituting an infraction or, notwithstanding any other provision of this Code, any such violation constituting a misdemeanor under this Code may, in the discretion of the City Attorney, be charged and prosecuted as an infraction. Any person violating any provision of any code adopted by reference by this code shall be guilty of a misdemeanor in accordance with §§ 93.99 and 151.999. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this code or any provision of any code adopted by reference by this code, or any provision of any code adopted by reference by this code or of any other city resolution or ordinance is committed, continued or permitted by the person and may be punished accordingly.
   (B)   Except in cases where a different penalty is prescribed by an ordinance of the city, any person convicted of an infraction for violation of an ordinance of the city is punishable by a fine not to exceed $100 for a first violation, a fine not to exceed $200 for a second violation of the same ordinance within one year, and by a fine not to exceed $500 for a third violation of the same ordinance within one year. At the discretion of the City Prosecutor, a third violation of the same ordinance within one year may be prosecuted as a misdemeanor, and the fines and penalties for misdemeanor violations as described elsewhere in this Code shall apply in that circumstance.
   (C)   When a misdemeanor penalty is prescribed by any ordinance of the city, any person convicted of the misdemeanor shall be punished by a fine of not more than $1,000 or by imprisonment in the County Jail not to exceed six months, or by both.
   (D)   A violation of local building and safety codes determined to be an infraction is punishable as follows: upon a first conviction, by a fine not exceeding $100; for a second conviction or any subsequent conviction within a period of one year by a fine not to exceed $500; and for each additional conviction or any subsequent conviction within a period of one year by a fine not to exceed $1,000.
