(A) Any violation of this chapter shall subject the offender to a civil penalty in the amount of $1,000.
(B) The civil penalty provided herein may be recovered by the city in a civil action in the nature of a debt if the offender does not pay the penalty within 20 days after the offender has been cited for the chapter violation. As used herein, CITED shall mean notified of the violation and the penalty in writing by an elected or appointed official of the city or the official attorney for the city or the city’s Police Department. The civil penalty may be used as an alternative to or in conjunction with the criminal penalties otherwise applicable.
(C) All civil penalties shall be paid to the city at the address shown on the citation, and placed in the General Fund.
(D) Each day a violation of the chapter occurs or continues shall be a separate and distinct offense, a separate civil penalty may be imposed for each such day.
(E) Each item sold or offered for sale in violation of the provisions of this chapter may be declared to be a separate offense and a separate civil penally may be imposed for each such item.
