§ 50.03  COLLECTION PRACTICES.
   (A)   Frequency of collection.
      (1)   Once a week for residential.
      (2)   Motels, restaurants, institutions and commercial establishments may require more frequent collection, if determined by the governing body or the Health Department to be essential to protect the health of the public. Sanitary storage of refuse shall be required.
   (B)   Location of wastes. Location of all solid wastes, both residential and commercial, shall be placed at a location, prior to scheduled collection, that is readily accessible to the collectors personnel.
      (1)   Residential. Garbage must be in approved receptacles which shall be placed at a single collection point. Trash must be in approved receptacles or tied in bundles as described herein and placed at a single collection point within three feet of the curb.
      (2)   Commercial and industrial. Bulk containers shall be kept on the premises in a place near the street, readily accessible to the collection vehicles. Noncontainerized businesses shall have refuse in approved receptacles which shall be placed at a single collection point readily accessible to the collection crew and vehicle.
   (C)   Licensing of collectors.
      (1)   It shall be unlawful for any person or firm who does not possess a current license from the town to engage in the business of solid waste collection or refuse disposal for compensation in the town. The town shall issue permits to such applicants. Such permits shall be limited to persons or firms having proper equipment and personnel to collect and dispose of refuse in accordance with the provisions of this subchapter.
      (2)   The fee for such license shall be set by Council from time to time per annum and all licenses shall be issued for the calendar year, or such part thereof as shall remain after the issuance. There shall be no reduction in the fee for a license issued after the beginning of any calendar year. The fee shall be paid to and receipted by the town. The permit shall be issued by the appointed agent.
      (3)   It shall be unlawful to permit an unlicensed collector to collect or remove refuse or solid waste from a household, institution or commercial enterprise.
   (D)   Collection vehicles.
      (1)   All vehicles used by the town or licensees for collection of solid waste shall be equipped with enclosed cargo spaces.
      (2)   It shall be unlawful to collect, haul, transport or convey solid waste or garbage in open, unenclosed vehicles except from one’s own residence directly to the landfill.
