It shall be unlawful for any person who owns or is in possession of a bitch to allow the same to run at large in the town while in heat. If the owner or possessor of any such animal is not known to the Chief of Police or, being the owner or possessor, fails to fasten up such animal during such period, either before or after a conviction for a violation of this section, after having been notified by the Chief of Police to do so, such animal shall be deemed to be a nuisance, and the Chief of Police or any such person as is designated by the Mayor may humanely destroy the same upon the order of the Mayor.
