§ 70.18  NO CRUISING AREAS.
   Upon application, in writing, by the owner or person in general charge of the operation of such area to the chief law enforcement officer of the town, the following regulations shall apply.
   (A)   No person shall drive or permit a motor vehicle under his or her care, custody or control to be driven past a traffic control point three or more times within a two-hour period from 6:00 p.m. to 4:00 a.m., Monday through Sunday or around a “posted” or “no cruising” area so as to contribute to congestion; obstruction of streets, sidewalks, parking lots or public vehicular areas; impediment of access to shopping centers or other buildings open to the public; or interference with the use of property or conduct of business in the area adjacent thereto.
   (B)   At every point where a public street or alley becomes or provides access to a “no cruising” area, there shall be posted a sign which designates “no cruising” areas and times.
   (C)   TRAFFIC CONTROL POINT, as used in this section, means any point or points within the “no cruising” areas established by the chief law enforcement officer of the town for the purpose of monitoring cruising.
   (D)   No violation shall occur except upon the third passage past the same traffic control point within a two-hour period.
   (E)   This section shall not apply to in-service emergency vehicles, taxicabs for hire, buses, vehicles being used for business in which a vehicle, because of a wreck or other emergency, is parked or left temporarily on the property.
   (F)   No person shall drive or permit a vehicle under his or her care, custody or control to be driven, parked, stopped or left standing within any area restricting such by signs conspicuously posted by the owner or person in general charge of the area providing: no trespassing between the hours of __.m. and__.m.
   (G)   Pursuant to VA Code § 46.2-1215, as amended, be it further ordained that the owner, operator, lessee or authorized agent of one having control of any parking lot or any part of a parking lot or area or of any other lot or building shall have the authority to remove, by towing or otherwise, to a licensed garage for storage until called for by the owner or his or her agent, any car left standing or abandoned in any area posted with the “No Trespassing” signs referred to in this chapter so long as the signs give notice that any such vehicle, if parked without permission, will be removed, towed or immobilized and the owner, operator, lessee or person in control of any such area, upon the proper posting of each signs shall have the rights and remedies prescribed by VA Code §§ 46.2-1215 et seq., as amended.
