§ 150.16 RESPONSIBILITY FOR PLAN REVIEW, INSPECTIONS AND ENFORCEMENT.
   (A)   The city shall assume plan review, inspection, and enforcement responsibility under the Kentucky Building Code adopted by § 150.01 for all buildings within the boundaries of its jurisdiction which:
      (1)   Are not more than three stories in height, exclusive of attic and basement;
      (2)   Do not contain more than 20,000 square feet of floor area;
      (3)   Are not educational or institutional occupancies;
      (4)   Are not frozen food locker plants;
      (5)   Are not places of assembly with a capacity for more than 50 persons;
      (6)   Are not business, industrial, or mercantile occupancies with a capacity of more than l00 persons;
      (7)   Are not state owned or leased; and
      (8)   Are not high hazard occupancies.
   (B)   The State Department of Housing, Buildings, and Construction shall retain plan review inspection and enforcement responsibility under the Kentucky Building Code for all other buildings within the city.
   (C)   The Department shall provide continuing education seminars for local building officials and plan reviewers; and shall assist the local Building Department on a consulting basis by providing interpretation service, enforcement assistance service, and administrative review service.
