§ 132.02 DEFINITIONS.
   The following words when used in this chapter shall have the meaning ascribed to them except where the context clearly indicates or requires a different meaning:
   "NUDITY" or "NUDE." Any portion of the pubic area, anus, vulva, or genitals, or any simulation thereof, the cleavage of the human buttocks, or for any female, the portion of the breast below a horizontal line across the top of the areola at its highest point or simulation thereof. This definition shall include the entire lower portion of the human female breast, but shall not include any portion of the cleavage of the human female breast exhibited by a dress, blouse, skirt, leotard, bathing suit, or other wearing apparel provided the areola is not exposed in whole or in part.
   "PENALTY." Any person who shall violate this chapter shall be guilty of a class B misdemeanor and shall be subject to fine and/or imprisonment as provided in the Kentucky Revised Statutes for a class B misdemeanor.
   "PUBLIC PLACE." The same as "Public Place" in KRS 525.010.
   "BUSINESS ESTABLISHMENT." A business within the city where liquor, beer and/or wine is sold for consumption on the premises pursuant to a retail drink liquor license and/or retail cereal malt beverage liquor license that has been issued by the State of Kentucky.
   "LICENSE." A retail drink liquor license or a retail cereal malt beverage liquor license issued by the State of Kentucky.
   "LICENSEE." Any person to whom a retail drink liquor license or a retail cereal malt beverage liquor license has been issued by the State of Kentucky, including the officers and agents of the licensee.
   "OCCUPATIONAL LICENSE." The occupational license issued for the business establishment pursuant to the city's occupational license Chapter 110 of this code which, notwithstanding any provision of this chapter, including ' 132.27 herein, shall remain in full force and effect.
   "PERSON." A human being, and, where appropriate, a public or private corporation, an unincorporated association, a partnership, a government or a governmental authority or any other group or combination acting as a unit.
   "PREMISES." The land and building in and upon which any business establishment regulated by alcoholic beverages statutes is carried on.
   "RETAIL LICENSEE." Any licensee, including its officers and agents, who sells at retail any alcohol beverage for the sale of which an occupational license is required.
   "LIQUOR ADMINISTRATOR." The duly appointed alcoholic beverage control administrator of the State of Kentucky.
   "ADULT DANCING ESTABLISHMENT." A business wherein employees, agents, or independent contractors perform dance routines.
   "ADULT ENTERTAINMENT ESTABLISHMENT." An adult motion picture theater, massage parlor, an adult book store, an adult dancing establishment, or any other such business establishment whose primary purpose is to offer adult oriented entertainment or matter as characterized by an emphasis on specified sexual activities and/or exposure of specified anatomical areas.
