1307.10 GRADE AND LANDSCAPING FEES; BONDS; PENALTY.
(a) Grade Fees. Upon the filing of an application and plans for a building permit for any new dwelling, in addition to the permit fees set forth in this chapter, the applicant shall:
(1) Post a cash bond in the amount of two thousand five hundred dollars ($2,500.00) for each and every new dwelling to cover the following:
A. All costs of reviewing and establishing a grade, and inspection thereof. All costs paid to the City Engineer, in relation to the establishment of the grade and final inspection thereof, shall be deducted from his cash bond.
B. All costs associated with insuring that the rough grading of the property is in accordance with the approved plans.
C. The cost of the City’s fifty dollar ($50.00) administrative fee.
(2) Upon inspection and approval of the rough grading by the City Engineer, the remaining cash will be refunded, less the costs specified above.
(3) If the applicant does not perform the rough grading as provided above, or if upon inspection, the City Engineer determines that the rough grading deviates from the approved plans and such deviation is not corrected within thirty (30) days from the date of the inspection, the applicant shall forfeit the cash bond.
(b) Landscaping Fees. In order to provide for proper drainage in the City, whoever provides landscaping services for any new dwelling, including subdivisions, shall:
(1) Post a cash bond at the time the occupancy permit is issued in the amount of two thousand dollars ($2,000.00) for every new residential dwelling to cover the following:
A. All costs of establishing a grade and inspection thereof. All costs paid to the City Engineer, in relation to the establishment of the grade and final inspection thereof, shall be deducted from this cash bond.
B. All costs associated with insuring that the rough grading of the property is in accordance with the approved plans.
C. The cost of the City’s fifty dollar ($50.00) administrative fee.
(2) Upon inspection and approval of the finished grade by the City Engineer, the remaining cash will be refunded, less the costs specified above.
(3) If, upon inspection by the City Engineer, any deviations or problems are discovered and such deviations and/or problems are not corrected within thirty (30) days from the date of the inspection, the applicant shall forfeit the cash bond.
