(A) It shall be unlawful and a misdemeanor punishable, as herein described, for any person to accumulate or to permit or to cause the accumulation in or about any premises or upon any road, street, alley, or public way adjacent to such premises owned or occupied by such persons, any solid waste in any amount or manner that will contribute to or result in danger to public health, or the creation or existence of a nuisance or safety hazard, or the pollution of water or air, or excessive land abuse.
(B) In addition to the criminal penalties for violation of this section, civil damages in an amount of up to three times the actual damage shall be imposed upon the person so convicted to be used to restore the lands to the original state. Such civil actions shall be brought in and for the county and any remainder of damages collected after restoration shall be used for maintenance and operation of the solid waste disposal system.
