§ 37.33 LAYOFF.
   (A)   The City Commission, upon recommendation of the CAO (Personnel Officer), may layoff an employee(s) after due consideration because of lack of work or funds.
   (B)   The order of layoffs shall be determined on the basis of needs of the city as recommended by the CAO/Personnel Officer.
   (C)   Temporary, seasonal and probationary employees shall be laid off before permanent employees.
   (D)   One week before the effective date of the layoff of a permanent employee, the Personnel Officer shall in writing:
      (1)   Notify the employee of the layoff;
      (2)   Explain to the employee the reasons for the layoff; and
      (3)   Certify whether the employee's service has been satisfactory.
   (E)   The City Commission may re-employ any former employee who has resigned from the city with a satisfactory employment record or who has been laid off because of lack or work or funds.
