Any person who violates a binding element shall be subject to a fine of not less than $500 nor more than $4,000 and shall comply with such remedial orders as may be issued by the Planning Commission, or the City of Hurstbourne (if the Planning Commission appoints a Hurstbourne Local Enforcement Officer). Each day during which the binding element violation exists after the period granted by § 154.04 to remedy the violation shall be deemed a separate offense.
