§ 37.52 MILITARY LEAVE.
   (A)   All employees of the city who are members of the National Guard or any reserve component of the Armed Forces of the United States shall be entitled to a leave of absence with full pay for a period not exceeding 15 calendar days in any one calendar year for the purpose of attending annual mandatory training.
   (B)   The City of Hurstbourne follows the Uniformed Services Employment and Re-employment Rights Act (USERRA). Employees are treated in regard to seniority as if they were not absent from work. This means they continue to accrue seniority just as if they were still employed and the employee has a right to return to the job the person would have held had he or she remained continuously employed, so long as the person is qualified for the job, or can become qualified after reasonable efforts by the employer. USEERRA does not require an employer to pay short- term compensation pay, such as vacation and sick days pay and the City of Hurstbourne does not pay vacation or sick days for employees called to military service. For absences of less than 30 days, health insurance (if the employee was entitled to a health insurance benefit) must continue as if the employee was not absent. USEERRA does not require an employer to pay health insurance past 30 days and Hurstbourne does not provide this benefit past a 30 day absence.
