ORDINANCE 2018 -14
AN ORDINANCE OF THE CITY COUNCIL OF HURRICANE, UTAH, AMENDING THE HURRICANE CITY CODE, TITLE 10, LAND USE, CHAPTER 7, SECTION 9, PERTAINING TO CONDITIONAL USE PERMITS FOR GREATER HEIGHTS AND SECTION 11 PERTAINING TO SPECIAL EXCEPTION; AND TABLE 10-13-2 PERTAINING TO ACCESSORY BUILDING LOCATION AND HEIGHT
WHEREAS the City Council of Hurricane, Utah has previously approved andadopted Title 10, Land Use; and
WHEREAS the City Council of Hurricane desires to amend Title 10, Chapter 7, Administrative and Development Review Procedures, Subsection 11(F) to clarify the Appeal of Decision process in accordance with Utah State Law; and
WHEREAS the Hurricane City Planning Commission has reviewed the proposed changes to accessory building heights to protect the quiet enjoyment of residential properties; and
WHEREAS a Public Hearing has been held and no objections to the proposed changes were heard; and
WHEREAS said Hurricane City Council deems it necessary and desirable for the preservation of the health, safety and welfare of the property owners and residents of Hurricane that said chapter be amended as hereafter provided,
   BE IT HEREBY ORDAINED that by the City Council of Hurricane, Utah as follows:
   A:   Title 10, Chapter 7, Subsections 9(E) 1 & 2 are hereby amended as follows:
   e. Standards for greater heights and size than permitted by this Code:
   (1) The height may not be greater than two (2) stories or 1.5 times the average height of    the immediately adjacent buildings, whichever is greater and the building must be of    compatible architecture with immediately adjacent buildings
   (2) When a greater height accessory building is approved, the building must be set back a    minimum of 5’ from side and rear property lines when the adjoining property is for single    family residential use.
   (2)(3) The greater size building desired must be of compatible architecture with    immediately adjacent buildings, must leave at least fifty percent (50%) of the lot on    which it is located free of buildings, and must be for a use permitted in the zone in which    it is located.              B:         Title 10, Chapter 7, Subsection 11(F), Special Exception hereby amended as       
                          follows:
10-7-11: SPECIAL EXCEPTION:
   F.  Appeal Of Decision: Any person adversely affected by a decision of the Appeal Board regarding a special exception may, within thirty (30) days    after such decision, may appeal to the District Court in accordance with Utah State Law.
   C:   Title 10, Chapter 13, Table 10-13-2, Development Standards in Residential          zones is hereby amended as follows:
