5-3-3: FIREARMS AND AIR RIFLES:
   A.   Definitions: For purposes of this section, the following terms shall have the following meanings:
AIR RIFLE: A BB gun, pellet gun or other device that could be used as a dangerous weapon from which is expelled a projectile by action of compressed air.
FIREARM: A pistol, revolver, handgun, shotgun, sawed off shotgun, rifle or sawed off rifle, or any other device that could be used as a dangerous weapon from which is expelled a projectile by action of an explosive.
   B.   Prohibition Of Discharge Of Firearms And Air Rifles: Except as permitted in subsection C of this section, it shall be unlawful for any person to discharge any firearm or air rifle from, upon or across any property within the boundaries of the city.
   C.   Exceptions To Prohibition: The prohibition against the discharge of firearms and air rifles contained in subsection B of this section shall not apply to the following:
      1.   The discharge year round of a shotgun, provided that in the event that the discharge is within six hundred feet (600') of any house, dwelling or building, or any other structure in which a domestic animal is kept or fed, including a barn, poultry yard, corral, feeding pen or stockyard, written consent of the owner or person in control of the property has been obtained;
      2.   The discharge of a firearm by any officer of the law in the performance of his duty;
      3.   The discharge of any firearm or air rifle at a shooting range or gallery approved by the chief of police;
      4.   The discharge of a firearm or air rifle by a citizen lawfully protecting or defending person or property, or protecting livestock or other domesticated animals from other predatory animals;
      5.   The discharge of any firearm for butchering or euthanasia of an animal by owner or designee;
      6.   The discharge of an air rifle in a manner which is not injurious to any person or property of another.
   D.   Limitations On Permitted Discharge: Any permitted discharge of firearms and air rifles pursuant to subsection C of this section, except by officers of the law in the performance of their duty, shall also be subject to the following limitations:
      1.   No firearm or air rifle shall be discharged from an automobile or other vehicle;
      2.   No firearm or air rifle shall be discharged from, upon or across any public street or highway;
      3.   No firearm or air rifle shall be discharged at any road signs placed upon any state highway or city street;
      4.   No firearm or air rifle shall be discharged at any communications equipment or property of public utilities including facilities, lines, poles, or devices of transmission or distribution;
      5.   No firearm or air rifle shall be discharged from, upon, or across Utah state park buildings, designated public camp or picnic sites, overlooks, golf courses, boat ramps, and developed beaches;
      6.   No firearm or air rifle shall be discharged from, upon or across any city park, golf course or other recreation area;
      7.   No firearm shall be discharged by any person under the age of fourteen (14), unless said person shall, at the time of such discharge, be accompanied by and in the immediate presence of a person eighteen (18) years of age or older;
      8.   No firearm shall be discharged from, upon or across the private property of another without permission of the owner or person in control of the property.
   E.   Violation And Penalties: Any person who:
      1.   Violates any provision of this section relating to the discharge of firearms shall be guilty of a class B misdemeanor and subject to penalty as provided in section 1-4-1 of this code.
      2.   Violates any provision of this section relating to the discharge of air rifles shall be guilty of an infraction and subject to penalty as provided in section 1-4-1 of this code. (Ord. 1-4-02, 1-3-2002)
