5-1-5: CITATION FOR MISDEMEANORS:
   A.   Authority: The City police or any peace officer, in lieu of taking a person into custody, or any public official charged with the enforcement of laws of this City, may issue and deliver a citation requiring any person subject to arrest or prosecution on a misdemeanor charge to appear at the Court of the Magistrate before whom the person could be taken pursuant to law if the person had been arrested.    B.   Court Appearance; Time; Failure To Appear: Utah Code Annotated section 77-7-19, is incorporated herein by reference. (1998 Code § 13-10-1-09)
   C.   Citation Contents:
      1.   If a citation is issued pursuant to subsection A of this Section, the peace officer or public official shall issue one copy to the person cited and shall within five (5) days file a duplicate copy with the court specified in the citation.
      2.   Utah Code Annotated section 77-7-20(2), is adopted by reference. (1998 Code § 13-10-1-10)
   D.   Citation In Lieu Of Complaint; Exceptions: Utah Code Annotated section 77-7-21, is adopted by reference, except, the reference to section 77-7-18 is amended to read "subsection A of this Section". (1998 Code § 13-10-1-11)
   E.   Wilfully Failing To Appear; Misdemeanor: Any person who wilfully fails to appear before a court pursuant to a citation issued under the provisions of subsection A of this Section is guilty of a Class B misdemeanor, regardless of the disposition of the charge upon which he was originally cited, and shall be subject to penalty as provided in Section 1-4-1 of this Code.
