§ 50.23 DEPOSITS FOR WATER SERVICE.
   Deposits shall be charged to any new user who has not already established a payment record with the Utility Billing Department. The deposit required will be set as follows: One inch line or less, $125 deposit; over one inch line, $200 deposit. This deposit may be used to pay for any damages the user may be liable for concerning water services, or it may be applied to any outstanding or delinquent utility service bills following service disconnect.
   (A)   Refund requirements. Deposits will be refunded upon user's request after and conditioned upon establishing a good payment record of no billing penalties for late payments for the most recent continuous 12 monthly billing periods.
   (B)   Redeposit terms.
      (1)   In the event a user's deposit has been applied to the user's utility service bill because of nonpayment, or has been used to pay for any damages for which the user may be liable, a redeposit will be required in the amount of a new deposit specified above.
      (2)   In addition, a user shall be required to provide a deposit in the amount of a new deposit specified above if either: (a) the user has been mailed disconnect notices for two consecutive months; or (b) the user has been mailed disconnect notices for any three months within the preceding 12 month period. If this deposit is not provided by the user, the water service to that property will be discontinued.
