(A) A petition for vacation of all or part of a plat shall be filed in accordance with IC 36-7-3-10 and the Rules of Procedure of the Commission. Filing fee of $50 shall be paid to the Department. The Commission may only approve the vacation of all or part of the plat, upon making written affirmative findings on each of the factors listed in IC 36-7-4-711(f).
(B) The owner of land in a plat may file with the Commission a petition to vacate all or part of the plat pertaining to the land owned by the petitioner. A petition shall be filed in accordance with IC 36-7-3-11 and the Rules of Procedure of the Commission. Filing fee of $100 shall be paid to the Department. The Plan Commission shall make a determination on the findings as required in IC 36-7-3-11.
