(A) A special non-reverting capital fund to be designated as the Parks Capital Fund is hereby established under authority of I.C. 36-10-3-22(b)(2) for acquiring land or making capital improvements for park and recreation purposes to any lands then owned or overseen by the Board of Parks and Recreation as permitted by then applicable authority, including but not limited to the following specific capital improvements:
(1) Capital improvements at Memorial Park, including Sunken Gardens;
(2) Capital improvements at Elmwood Park;
(3) Capital improvements at Laurie Park;
(4) Capital improvements at Hier's Park;
(5) Capital improvements at Yeoman Park;
(6) Capital improvements at Erie Park;
(7) Capital improvements at Evergreen Park;
(8) Capital improvements at General Slack Park;
(9) Capital improvements at Drover Park;
(10) Capital improvements at the Neighborhood Recreation Center.
(B) The Parks Capital Fund shall be funded by money which is received either from:
(1) Fees other than from the Department's major facilities; or
(2) From the sale of Department's personal property as directed by the Board of Parks and Recreation; and
(3) Otherwise as is then permitted by applicable law.
(C) Money in the Parks Capital Fund may be expended only for the purposes set out in this section, after appropriation by the Common Council, and upon the authority of approved claims allowed and signed by the president and secretary of the Board of Parks and Recreation.
