§ 100.35 NEW SIDEWALK SPECIFICATIONS.
   (A)   All new sidewalks constructed in the city shall be made out of concrete.
   (B)   This section shall not be construed to prevent the placing of any sidewalk constructed out of brick to grade by relaying the brick out of which the existing sidewalk is built.
   (C)   Concrete sidewalks shall be not less than four inches thick, not less than four feet wide, and conform to slope and joint requirements as set forth in "Construction Standards Typical Concrete Sidewalk," copies of which are on file in the City Engineer's office and the City Clerk-Treasurer's office and which Standard is adopted and incorporated by reference as part of this chapter. Insofar as possible, width of new walks shall match that of neighboring walks.
   (D)   Minimum 28-day compressive strength of concrete used shall be 3,500 pounds per square inch (3,500 P.S.I.).
   (E)   When sidewalk is laid to the curb, the new walk shall be poured monolithic with the curb, removing old curbing as necessary.
   (F)   Sidewalks shall be installed along street right-of-ways for any new building on a vacant lot or property prior to a certificate of occupancy being issued.
   (G)   The requirement to provide sidewalks may be waived by the Board of Public Works and Safety, prior to any building/construction on the lot, for projects not subject to development plan review, if the new building is located within a block, or in an area, where there are no existing sidewalks.
   (H)   The requirement to provide sidewalks may be waived by the Plan Commission, when reviewing a development plan application, if the new building is located within a block, or in an area, where there are no existing sidewalks.
