ORDINANCE NO. 5-C-90 (984)

   REENACTING AS AN ORDINANCE, A CODE OF ORDINANCES FOR THE CITY OF HUNTINGTON, INDIANA REVISING, AMENDING, RESTATING, CODIFYING, AND COMPILING CERTAIN EXISTING GENERAL ORDINANCES OF THE CITY OF HUNTINGTON DEALING WITH SUBJECTS EMBRACED IN THE CODE OF ORDINANCES

   WHEREAS, the acts of the General Assembly of the State of Indiana empower and authorize Common Council of every city to adopt, revise, amend, restate, codify and compile any existing ordinances not heretofore adopted or published and to incorporate said ordinances into one ordinance book form; and

   WHEREAS, the Common Council of Huntington, Indiana has authorized a general compilation, revision, and codification of ordinances of the City of a general and permanent nature and publication of such ordinances in book form.

   NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Huntington that:

   Section 1. The ordinances of the City of Huntington, as heretofore adopted by Common Council and revised in the form attached hereto and incorporated herein by reference as Group Exhibit "A" and designated as the 1989 S-1 Supplement and 1990 S-2 Supplement are herein adopted as revised, amended, restated, codified and compiled for the purposes of the incorporation of such ordinances in the City of Huntington Code of Ordinances ("Code"). The S-1 Supplement shall be deemed adopted prior to the adoption of the S-2 Supplement, and the S-2 Supplement shall be adopted with the corrections set forth in the letter to American Legal Publishing dated April 6 which attached hereto and incorporated herein by reference as Exhibit "B".

   Section 2. All prior ordinances pertaining to the subjects treated in the above referenced ordinances shall be deemed repealed from and after the effective date of this Ordinance except as they are included and reordained in whole or in part in the Huntington Code of Ordinances, including the S-1 and S-2 Supplements updated through Ordinance 37-C-89.

   Section 3. This reenacted Code, as supplemented, shall be deemed published as of the day of its adoption and approval by Common Council, and the Clerk-Treasurer of the City of Huntington is hereby authorized and directed to file and retain a copy of this reenacted Code, as supplemented, in her office and to file the S-1 and S-2 Supplements with the Office of the Clerk in Huntington County, and to mail the S-1 and S-2 Supplements to all City of Huntington Code of Ordinances subscribers as shown on the master list of code subscribers maintained by the Clerk-Treasurer.

   Section 4. The reenacted Code, as supplemented, shall be in full force and effect two weeks from the date of its publication and filing hereof in the Office of the Clerk-Treasurer and the Clerk of Huntington County.
