§ 97.03 SOUND GENERATION AND/OR AMPLIFICATION; GENERALLY.
   It is a violation of this chapter to use, operate or permit to be played, used, or operated, any machine or device for the producing, reproducing or amplifying of sound in:
   (A)   Such manner as to disturb the peace, quiet and comfort of any reasonable nearby person of normal sensibilities at any time, with louder volume than is necessary for the convenient hearing of a reasonable person of normal sensibilities who is legally and appropriately near the location at which such machine or device is operated and who is a voluntary listener, is a violation of this chapter;
   (B)   Or on any of the following:
      (1)   Public property, including any public right-of-way, highway, building, sidewalk, park or thoroughfare, if a material portion of the sound so generated is audible at a distance of 35 feet from its source;
      (2)   A motor vehicle on a public right-of-way, highway, or public space if a material portion of the sound so generated is audible at a distance of 35 feet from the device producing the sound.
