§ 55.91 VIOLATIONS.
   (A)   It shall be a violation of this chapter for any person, firm or corporation, whether as owner, tenant, lessee, occupant, contractor, or subcontractor, to:
      (1)   Occupy any building or structure, which required development plan or subdivision plat approval, when the stormwater management system has not been completed in compliance with the approved plans.
      (2)   Construct a stormwater management system in violation of the approved plan.
      (3)   Commence site excavation prior to development plan or subdivision plat approval.
      (4)   Alter, move, relocate or use any portion of an approved stormwater management system without prior approval of the Commission.
      (5)   Fail to maintain an approved stormwater management system in operating condition.
   (B)   Upon a violation set forth in division (A) above, the City Engineer may impose any one or all of the following remedies:
      (1)   A stop work order, whereby all work on the site, including any building construction, shall cease at the time of posting.
      (2)   A revocation of a certificate of occupancy or any permit issued under Chapter 150 (Building Code).
      (3)   Request the City Attorney file an action in the Circuit or Superior Court to enforce this chapter, and have fines and penalties imposed as provided in § 55.99.
      (4)   Any other remedy or penalty provided for herein, or by other applicable law.
