(A) "QUALIFIED WASTE" means materials to be accepted by Nature's Fuel Huntington, LLC listed on Exhibit B of a certain lease by and between the City of Huntington, Indiana and Nature's Fuel Huntington, LLC for real estate owned by the city and located within its landfill signed and effective during September 2009 ("lease") and Exhibit C of a certain Waste to Energy Operating/Processing Agreement by and between the City of Huntington, Indiana and Nature's Fuel Huntington LLC signed and effective during September 2009 ("operating agreement"). "QUALIFIED WASTE" excludes those materials listed on any exhibits denoted as materials not to be accepted by Nature's Fuel Huntington LLC.
(B) Only in accordance with the lease and operating agreement, as each is appropriately amended from time to time, the landfill may accept such qualified waste for processing by Nature's Fuel Huntington LLC, notwithstanding § 95.25 and any other provision of this chapter to the contrary.
